Terms of Service
1. Introduction
ITSkills4U (https://itskills4u.com.ua) is an IT training program website provided by CloudTeam Sp. z o.o.. Its mission is to offer free AWS training for Ukrainian refugees residing in Poland and certain other countries in Europe. These Terms of Service (“Terms”) govern your use of the ITSkills4U platform and participation in the training program. By accessing or using the ITSkills4U website or enrolling in the program, you acknowledge that you have read, understood, and agree to be bound by these Terms.
2. Eligibility
To participate in the ITSkills4U program, you must meet the following eligibility criteria:
- Ukrainian Refugee Status: You must be a Ukrainian citizen who has refugee or displaced status as a result of the conflict in Ukraine. The program is intended specifically for Ukrainian refugees.
- Residency in Supported Countries: You must currently reside in Poland or one of the other supported countries for this program (such as Bulgaria, Croatia, Czech Republic, Estonia, Greece, Hungary, Latvia, Lithuania, Romania, Slovakia, or Slovenia). These supported countries may be updated based on program scope.
- Minimum Age: Participants must be at least 18 years old. The program is not available to minors.
- Language Skills: Some training courses or materials are in English. Basic English proficiency may be required to successfully participate in certain programs or to communicate with instructors and peers.
By signing up, you confirm that you meet the above eligibility criteria. CloudTeam reserves the right to request proof of eligibility (for example, verification of your Ukrainian citizenship and residency) at any time. If you do not meet these criteria or fail to provide satisfactory proof when asked, you may be deemed ineligible for the program.
3. Program Enrollment
Enrollment in ITSkills4U is straightforward and does not require creating a traditional user account on the platform:
- Signup Process: To join the program, you need to fill out and submit the program signup form (registration form) available on the ITSkills4U website. You are not required to create a login account for the website; enrollment is handled through this form and subsequent communication (such as email confirmations).
- Accurate Information: You must provide accurate, current, and complete information during the signup and enrollment process. This includes your name, contact information, and any details requested to confirm your eligibility (e.g. proof of Ukrainian refugee status and current country of residence). Do not provide false, misleading, or outdated information.
- Verification of Eligibility: CloudTeam reserves the right to verify your identity and eligibility at any stage. This may include checking documentation or using secure identity verification methods to confirm your Ukrainian citizenship and residency in a supported country. If you refuse to provide necessary information or if CloudTeam cannot verify your eligibility, your enrollment may be delayed or denied.
- Acceptance and Denial: Submitting a signup form does not guarantee acceptance into the program. CloudTeam (or its program partners) will review your application to ensure criteria are met. If you meet the requirements and slots are available, you will be accepted and notified about next steps (such as course schedules or onboarding details). CloudTeam reserves the right to deny or revoke participation if you do not meet the eligibility criteria or if you violate any Terms at any point.
- No Fees: Enrollment in ITSkills4U is free of charge. You will not be asked for payment for any of the training courses or materials. (Note: You are responsible for your own equipment and internet access to participate in online training, but the program itself does not charge fees.)
By enrolling in the program, you agree to abide by these Terms throughout your participation.
4. User Conduct
All participants are expected to behave in a professional and respectful manner. By using the ITSkills4U platform and participating in the training, you agree to the following rules of conduct:
- Respectful Engagement: Treat instructors, CloudTeam staff, and fellow learners with courtesy and respect. Harassment, discrimination, or abusive language/behavior (whether in online forums, chat, video sessions, or in-person events) is strictly prohibited.
- No Disruptive Behavior: Do not engage in any behavior that disrupts the learning environment or the experience of others. This includes spamming discussion channels, repeatedly interrupting instructors, or any form of misconduct during training sessions or program events.
- Academic Integrity: Commit to honest participation. Do not cheat on quizzes or exams, and do not falsely represent your progress or skills. The goal is to genuinely learn and develop your abilities.
- No Sharing of Access: Do not share any login credentials, access links, or personal entry codes provided to you with anyone else. Even though the platform itself does not require a login account, you might receive credentials or links for related services (for example, access to an online classroom, learning management system, or cloud resources for labs). These are meant for your personal use only as an enrolled participant. Sharing your personal access with others is not allowed and may result in removal from the program.
- No Unauthorized Distribution of Materials: Training materials provided through ITSkills4U (including videos, slides, documents, practice questions, and other resources) are for your personal educational use only. You must not copy, distribute, publish, or make these materials available to anyone who is not authorized to access them. This means you should not upload course content to public websites, share it on social media, or sell/give it to others.
- Legal Compliance: You agree not to use the ITSkills4U platform or any related services for any unlawful or illegal activities. You must not attempt to hack, attack, or impair the website or any systems. Additionally, do not upload or share content that is illegal, offensive, or violates any third-party rights.
- Follow Additional Guidelines: From time to time, CloudTeam or instructors may issue additional guidelines or rules for specific activities (for example, etiquette for live webinars, or rules for an in-person workshop). You agree to follow those instructions as part of these Terms.
If you engage in behavior that violates these conduct rules, CloudTeam may issue a warning, limit your participation (for example, mute or remove you from a session), or remove you from the program altogether (see Termination below). Always strive to maintain a positive and supportive learning atmosphere for everyone involved.
5. Intellectual Property Rights
All content and materials provided through the ITSkills4U platform are protected by intellectual property laws and are owned by CloudTeam Sp. z o.o. or its partners and licensors (such as Amazon Web Services or other content providers). This includes, but is not limited to, the website design and text, curriculum materials, slides, documents, videos, graphics, logos, and any CloudTeam or ITSkills4U branding.
By participating in the program, you acknowledge and agree to the following regarding intellectual property:
- Limited Personal Use: You are granted a limited, revocable, non-transferable license to access and use the course materials and content for your own personal learning purposes only during the program. This license is solely for you as an individual participant and does not transfer any ownership rights to you.
- No Copying or Distribution: You may not copy, reproduce, modify, publish, upload, post, transmit, or distribute any material from ITSkills4U or CloudTeam without prior written permission. This means you cannot take the course content and share it with friends, upload it to another website, or incorporate it into your own teaching materials. The only exception is if explicit permission is given (for example, if certain resources are provided with a Creative Commons license or similar, but unless stated, assume all rights are reserved).
- No Commercial Use: Under no circumstances may you sell, resell, or commercially exploit any of the training content or access to the program. The training is provided free for your benefit; you cannot charge others for the materials or any derivative of them.
- CloudTeam and Partner Trademarks: The name CloudTeam, ITSkills4U, and associated logos and names of services (like AWS) are trademarks or service marks of CloudTeam or its partners. You are not permitted to use these trademarks without permission. For example, you cannot use CloudTeam’s logo in your own advertising or create a competing service using the ITSkills4U name.
- User Content: If, as part of the program, you contribute any content (such as posts in a forum, feedback, assignments, etc.), you ensure that you have the right to share that content. By posting or submitting such content, you give CloudTeam a license to use it for program-related purposes (for example, to display your question to other learners or to use your feedback to improve the course). CloudTeam will respect your personal data rights as outlined in the Privacy Policy, but purely for the content’s intellectual property aspect, you give CloudTeam permission to utilize what you share within the context of the program.
Any unauthorized use of the platform content or intellectual property may result in immediate termination of your access to the program (see Termination section) and could have legal consequences. Always respect the effort and rights involved in creating the educational materials you are using.
6. Disclaimers & Limitations of Liability
Educational Purpose Only: The ITSkills4U platform and its training programs are provided for educational and informational purposes only. While the goal is to help you develop valuable cloud computing skills and even prepare you for AWS certification exams, CloudTeam does not guarantee that you will successfully obtain any certification, secure employment, or achieve any specific outcome as a result of participating in the program. Your success will depend on your own efforts and circumstances outside the scope of this training.
“No Warranty” on Services: The ITSkills4U platform and all content and services provided through it are offered on an “as is” and “as available” basis. CloudTeam, and its partners, make no warranties or representations of any kind, either express or implied, about the completeness, accuracy, reliability, suitability, or availability of the website or the training content. For example, CloudTeam does not warrant that: – The training materials will meet all of your expectations or requirements. – The website or webinars will be uninterrupted, timely, secure, or error-free. – The information provided (such as job hunting tips or technical instructions) is perfectly accurate or up-to-date, though we strive to keep content current.
Any reliance you place on the information from the program is at your own risk. We provide guidance and resources, but you are responsible for how you implement and use them.
Limitation of Liability: To the fullest extent permitted by applicable law, CloudTeam (and its directors, officers, employees, and partners) will not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages that may result from your use of the ITSkills4U platform or participation in the program. This includes, for example: – Loss of opportunity or employment prospects, – Any harm to your personal devices or data (e.g., from downloading course materials or using recommended software), – Personal dissatisfaction or psychological discomfort, – or any other losses or damages, even if we have been advised of the possibility of such damages.
CloudTeam is not responsible for any problems beyond its control, such as issues with third-party services (for instance, if an external video conferencing tool fails), “force majeure” events (e.g., natural disasters, internet outages, or other extraordinary events), or if you incur any costs (like internet data charges) while participating.
No Professional Advice: Any career advice, job placement assistance, or other guidance provided through ITSkills4U is for general informational purposes and does not constitute professional career counseling or a guarantee of a job. Always use your own judgment and, if needed, seek professional advice for important decisions.
Because some jurisdictions do not allow certain exclusions or limitations of liability or warranties, some of these limitations may not fully apply to you. However, in such cases, CloudTeam’s liability will be limited to the maximum extent permitted by law.
7. Termination
This section explains how participation in the ITSkills4U program can be terminated by either you or CloudTeam:
- Termination by User: You are free to stop using the ITSkills4U platform and to discontinue your participation in the program at any time. Since there is no paid commitment or long-term obligation, you can simply notify CloudTeam (if you wish, via email) that you will no longer participate, or simply stop attending and using the resources. Keep in mind that even if you discontinue, the obligations and restrictions you agreed to (such as not sharing materials or respecting intellectual property) will continue to apply to any materials you already received.
- Termination by CloudTeam: CloudTeam reserves the right to suspend or terminate your access to the program at any time if, in CloudTeam’s judgment, you violate these Terms or engage in behavior that harms other users, the platform, or the integrity of the program. Termination may be immediate and without prior notice if the violation is serious (for example, blatant plagiarism of materials, harassment of an instructor or other participants, or fraudulent misrepresentation of eligibility). CloudTeam may also terminate the program or your participation if it is required to do so for legal reasons or if the supporting organizations or circumstances change (though we aim to allow enrolled users to complete any ongoing courses).
- Effect of Termination: If your participation is terminated (by you or by CloudTeam), you will lose access to any further training sessions, materials, or program benefits from the date of termination. If CloudTeam terminates your access due to a breach of Terms, CloudTeam may also choose to bar you from re-enrolling in the future.
- No Financial Obligation: Since the program is free, termination does not involve refunds. If you have incurred personal expenses (such as travel to a workshop or internet costs), CloudTeam is not liable for those costs in the event of termination.
- Surviving Provisions: Even after termination, certain sections of these Terms will remain in effect (such as Intellectual Property Rights, Disclaimers & Liability, Dispute Resolution) to the extent applicable, as they govern obligations and limits that continue beyond your active participation.
CloudTeam will make decisions on termination in good faith, aiming to be fair and reasonable. If you believe your access was terminated in error, you may contact CloudTeam to discuss the matter (see Contact Information below).
8. Dispute Resolution
These Terms and any dispute arising from your participation in the ITSkills4U program are governed by the laws of Poland. In the unlikely event of a dispute or claim that arises between you and CloudTeam related to the use of the platform or these Terms, the following process and rules will apply:
- Negotiation First: We encourage you to first contact CloudTeam to attempt to resolve any issue informally. Often, misunderstandings or problems can be solved through communication.
- Arbitration: If a dispute cannot be resolved amicably, you and CloudTeam agree to resolve any claim or controversy through binding arbitration, rather than through courts of general jurisdiction. The arbitration shall be conducted in Poland under the rules of an established arbitration body in Poland, and it will be governed by Polish law. The language of the arbitration can be English or another language agreeable to both parties, but unless otherwise agreed, important documents may need translation into Polish for legal enforceability.
- Waiver of Court Proceedings: By agreeing to arbitration, both you and CloudTeam waive the right to a trial in court or to participate in a class action for the dispute (meaning you cannot join your claim with others in a lawsuit, nor pursue claims as a representative of a group or class of users).
- Exceptions: Notwithstanding the above, CloudTeam reserves the right to seek injunctive or equitable relief in a court of law for any violation of intellectual property or unauthorized use of the platform, since such issues may require immediate legal intervention. Also, if applicable law does not allow mandatory arbitration for a particular type of dispute, then that specific dispute may be resolved by the competent courts in Poland, and the remaining issues will still go to arbitration.
- Jurisdiction: If for any reason a dispute is determined not to be subject to arbitration, or for enforcement of an arbitration award, you agree to the exclusive jurisdiction of the courts of Poland, and you agree that such courts would be a proper forum.
This dispute resolution clause does not restrict either party’s rights to report issues to an administrative authority (for example, you can always contact data protection authorities for privacy issues, and CloudTeam can report unlawful activity to law enforcement). It mainly governs how civil disputes are handled. By using the platform, you show that you understand and agree to this arbitration agreement and choice of Polish law.
9. Changes to the Terms
CloudTeam may update or modify these Terms of Service from time to time to reflect changes in the law, changes in the program, or for other operational reasons. When changes are made, we will:
- Update the Version on the Website: The most current version of the Terms will be posted on the ITSkills4U website (typically accessible through a “Terms of Service” or “Terms & Conditions” link). An updated date or version number will be indicated at the top or bottom of the Terms document.
- Notify Users of Changes: If the changes are significant, we will provide a notice of the update. This notice might be posted on the website, sent via email to participants, or presented to you upon your next interaction with the platform. Minor changes (like clarifications or typographical corrections) may not be individually announced, but will still be reflected in the posted Terms.
- Your Continued Use Constitutes Acceptance: Once updated Terms are posted, they become effective immediately (unless a later date is specified). By continuing to use the ITSkills4U platform or remaining in the program after the Terms have been updated, you are agreeing to the revised Terms. If you do not agree with the changes, you should stop using the platform and may withdraw from the program.
- Review Regularly: We encourage you to review the Terms periodically to stay informed about any updates. It’s important you understand your rights and obligations at all times.
